TERMS AND CONDITIONS OF SALE


ARTICLE 1 – APPLICATION OF THE TERMS AND CONDITIONS OF SALE
The act of any person, hereinafter referred to as the customer, ordering a product offered for sale or free of charge on the site implies full and complete acceptance of these general terms and conditions of sale, which the customer acknowledges having read prior to placing the order.
Acceptance of these Terms and Conditions implies that users have the necessary legal capacity or, failing that, have the authorization of a guardian or curator if they are incapacitated, or their legal representative if they are minors.
MFBG Productions SARL, hereinafter referred to as the seller or Raging Heroes, reserves the right to modify the Terms and Conditions at any time, provided that such changes are posted on its website. The terms and conditions applicable to the user are those in effect on the day of their order or connection to this site.


ARTICLE 2 – PRICES
Prices shown on the site include all taxes, excluding delivery charges. The seller reserves the right to change prices at any time without notice. Of course, in case of change, the price applied to the customer will be the one invoiced at the time of order registration, subject to availability.

Delivery charges are indicated to the customer before payment. However, these delivery charges do not include any customs duties, import taxes, or other fees that may be charged to the customer for deliveries outside the European Community. It is the customer’s responsibility to check these charges with the relevant authorities before placing the order.


ARTICLE 3 – SATISFACTION OR REFUND
If the purchased product does not fully satisfy the customer, they may return it to the seller within 7 days upon request, without penalties except for return shipping costs. The seller commits to fully refund the products. The customer must simply follow the return procedure described in Article 8 below and return the product at their own expense.

Products must be returned in perfect condition, in their original undamaged packaging.

No exchange or refund can be made without a return authorization number.

After the 7-day period, products are considered accepted and conform to the order.


ARTICLE 4 – PRODUCT UNAVAILABILITY
In the event an item becomes permanently unavailable, a credit or refund may be obtained free of charge.


ARTICLE 5 – DELIVERY
Destinations
We deliver essentially worldwide.

Costs
Shipping costs are the same worldwide.
The customer can choose between two delivery methods: Simple Delivery at 5 Euros and Insured Delivery at 10.50 Euros. These prices may be reduced during promotional operations.
Simple Delivery is not guaranteed. The seller declines all responsibility if an order does not reach its destination. Insured Delivery is guaranteed. If an order does not arrive at its destination more than 30 days after its delivery date (according to the carrier's records), a new order will be shipped at the seller's expense.

The seller reserves the right to modify the shipping costs without prior notice.

Methods and Deadlines
Products are delivered to the delivery address indicated during the order, normally within two weeks, and within a maximum period of 30 days from the receipt of payment of the said order by the seller.

Shipping is done by La Poste, according to the delivery method chosen at the time of order. The seller reserves the possibility of using other modes of transport.

Shipping times correspond to the processing and sending time of the order by the seller's services. Delivery times correspond to the time it takes the carrier to deliver the order.
The shipping and delivery times given on the site are indicative only and do not engage MFBG Productions SARL in any obligation of deadline. The seller cannot be held responsible for consequences due to a possible delivery delay.

Any order not shipped within 30 days of the order is canceled unless otherwise stipulated and announced in the sales offer, particularly for pre-order items.

Order Splitting
Orders are not split. If items are deliverable at different dates depending on their availability, the delivery time is based on the longest delay. The seller reserves the possibility to split deliveries but in this case, it bears the additional costs and the participation in processing and shipping costs will only be charged for one shipment.

Outside the European Community
When the delivery address is located outside the territory of the European Community, it is the buyer's responsibility to bear any additional costs and customs or other taxes generated by this delivery. It is also the buyer's responsibility to inquire about any prior formalities that must be completed and to fulfill them.

Damaged Package
If the package is delivered damaged or in poor condition, the buyer must refuse it so that the guarantee offered by the carrier can apply. In this case, they must inform the seller so that a new shipment of the order can be prepared. In such a case, the maximum delivery times announced in these terms and conditions no longer apply.


ARTICLE 6A – DEFECTIVE PRODUCT
If a product is defective, the customer has a period of 7 days from the date of receipt to request an exchange or refund.

To exercise this right, the customer must simply follow the return procedure described in Article 8 below and return the product at their own expense. These return costs will be credited or reimbursed by bank check or transfer upon receipt of the package.

No exchange or refund can be made without a return authorization number.


ARTICLE 6B – PREPARATION ERROR
If the delivered products are not those ordered, the buyer may request an exchange or refund. To do so, the customer must simply follow the return procedure described in Article 8 below and return the product at their own expense. These return costs will be credited or reimbursed by bank check or transfer upon receipt of the package.

No exchange or refund can be made without a return authorization number.

Products must be returned in perfect condition, in their original undamaged packaging. Incomplete, damaged, or soiled items by the customer will not be accepted.

In the case of an exchange, a new delivery period begins upon receipt of the return by the seller. In the case of a refund, it will be made within 15 days of receipt of the return by the seller.


ARTICLE 7 – RIGHT OF WITHDRAWAL
In accordance with current legislation, the customer has a period of 7 working days from the date of receipt of the package to request an exchange or refund.
To do so, the customer must simply follow the return procedure described in Article 8 below and return the product at their own expense.

No exchange or refund can be made without a return authorization number.

The amount of the returned item(s) will be refunded, at the seller's choice, by check or by credit to the bank card within a maximum period of 30 days from receipt of the package. In case of exchange, a contribution to delivery costs may be requested.

Products must be returned in perfect condition, in their original undamaged packaging.


ARTICLE 8 – CUSTOMER SERVICE / PRODUCT RETURN PROCEDURE

For any product return, the customer must follow the procedure described here.

1. The customer must send an email to contact@ragingheroes.com in which he will briefly describe the reason for the return (right of withdrawal, defective product, preparation error, etc.), and will request either a refund or an exchange.
2. The customer will then receive an authorization number as well as an address allowing them to proceed with the return of the package.
3. The customer must then return the product at their own expense, imperatively including the return authorization number.

Products must be in good condition and in their original packaging as they were delivered.

Attention: No exchange or refund can be made without a return authorization number.


ARTICLE 9 – LIABILITY
The products offered comply with the current French legislation. The seller's liability cannot be engaged in case of non-compliance with the legislation of the country where the products are delivered.

The products sold by Raging Heroes are NOT toys. They are collectible items designed and marketed for adults and not for children, regardless of their age. Unless otherwise indicated in the product description, please note that if these items were used as 'toys', they would automatically be considered non-compliant with the statutes, rules, and legislation in force concerning the toy market. Raging Heroes accepts no responsibility for any risks and damages of any kind that may be caused or generated by the use of its products.

The photographs and texts illustrating the products presented are not contractual. Consequently, the seller's liability cannot be engaged in case of error in any of these photographs or texts. In case of doubt about the characteristics of a product or for additional information, please contact customer service (contact@ragingheroes.com).

The seller cannot be held responsible for non-performance of the contract in case of force majeure, including natural disasters, war, strike, flood, fire, etc.


ARTICLE 10 – APPLICABLE LAW / DISPUTES
The language of these general conditions is French.
These general conditions are subject to French law.
In case of dispute, French courts shall have sole jurisdiction.

Before any legal proceedings, an amicable resolution is of course preferable. Claims or disputes will always be received with attentive goodwill, good faith always being presumed in those who take the trouble to expose these situations. In case of dispute, the customer will primarily contact the company to obtain an amicable solution.
It is expressly reminded that requests for amicable settlement do not suspend the deadlines for initiating legal action. Unless otherwise provided by mandatory provisions, any legal action relating to the execution of this contract must be submitted to the jurisdiction of the Court of Appeal of PARIS.

If any clause of these general conditions is declared null by a court decision, this nullity shall not affect the validity of the other clauses, which shall continue to produce their effect.


ARTICLE 11 – MISCELLANEOUS CLAUSES
In case of inability to access the site, due to technical problems or any other reasons, the customer cannot claim any damage and cannot demand any compensation.

The unavailability, even prolonged and without any time limit, of one or more products cannot constitute a prejudice for the users and cannot in any way give rise to the granting of damages by the site or its publisher.
